U.S. State Privacy & Consumer Rights + Terms Addendum

This U.S. State Privacy & Consumer Rights + Terms Addendum (“Addendum”) supplements the Privacy Policy, Terms of Use, and SMS & Text Messaging Privacy Policy of FIREpwr

This Addendum provides additional disclosures and rights information to individuals residing in U.S. states with enhanced privacy, consumer protection, telemarketing, or data-handling requirements.

This Addendum applies to residents of states including, but not limited to:

California, Colorado, Virginia, Connecticut, Utah, Texas, Nevada, Oregon, Montana, Delaware, Iowa, Tennessee, Florida, and any state adopting similar privacy or consumer data laws.

Although certain state laws provide exemptions or modified obligations for nonprofit organizations, FIREpwr voluntarily implements transparency and consumer-rights practices consistent with widely recognized privacy standards.

1. Scope of Covered Interactions

This Addendum applies to personal information collected through:

  • firepwr.org

  • Event and training registration forms

  • Chapter sign-ups

  • Volunteer applications

  • Donation platforms

  • Email, SMS, phone, or in-person communications

  • Advocacy participation forms

  • Community outreach initiatives

This Addendum applies regardless of whether an individual ultimately participates in a program.

2. Categories of Personal Information Collected

Depending on your interaction with FIREpwr, we may collect:

Identifiers

  • Name

  • Mailing address

  • Email address

  • Phone number

  • State of residence

Participation & Engagement Information

  • Event registrations

  • Chapter affiliations

  • Volunteer interests

  • Advocacy participation preferences

  • Donation history

Demographic Information (Voluntarily Provided)

  • Age range

  • General geographic location

Communications

  • Messages

  • Form submissions

  • Support inquiries

  • SMS interactions

Technical & Usage Data

  • IP address

  • Device type

  • Browser type

  • Pages visited

  • Timestamps

  • Referral sources

FIREpwr does not knowingly collect firearm ownership records, serial numbers, or sensitive government identification numbers unless legally required for a specific event or compliance purpose.

3. Purposes for Data Collection

Personal information is used only to:

  • Register individuals for events or programs

  • Process donations

  • Coordinate volunteers and chapters

  • Respond to inquiries

  • Support advocacy initiatives (when requested)

  • Improve program effectiveness

  • Maintain nonprofit operational records

  • Comply with legal and regulatory obligations

  • Protect against fraud or misuse

We do not use personal information for commercial resale or third-party advertising.

4. Sale, Sharing, and Targeted Advertising

FIREpwr:

  • Does not sell personal information

  • Does not participate in data brokerage

  • Does not engage in cross-context behavioral advertising

  • Does not share personal data for commercial marketing

Any sharing is limited to service providers necessary to operate programs (e.g., secure payment processors, event platforms).

5. Sensitive Personal Information Handling

Certain states require special disclosures regarding sensitive data.

FIREpwr may receive limited voluntary information related to:

  • Participation in safety training

  • Advocacy involvement

  • Chapter leadership roles

Sensitive information is:

  • Used only for mission-related purposes

  • Limited to the minimum necessary

  • Not used for profiling with legal or similarly significant effects

  • Not used for commercial purposes

 

6. Consumer Privacy Rights (Where Applicable)

Residents of applicable states may have the following rights:

Request categories and purposes of personal information collected.

Right to Access

Obtain a copy of personal data maintained.

Right to Correct

Request correction of inaccurate information.

Right to Delete

Request deletion, subject to legal, audit, or nonprofit record retention obligations.

Right to Data Portability

Request information in a usable format where feasible.

Right to Opt Out

Opt out of:

  • Sale of personal information (not applicable)

  • Targeted advertising (not performed)

  • Profiling with legal effects (not performed)

Right to Non-Discrimination

You will not be denied services or participation for exercising privacy rights.

7. Request Submission & Identity Verification

We may request reasonable identity verification to protect against unauthorized disclosure.

Responses are typically provided within 30–45 days, consistent with applicable state requirements.

8. Appeals Process

Where required by state law, individuals may appeal denied requests by replying to our response or submitting a new request marked “Appeal.”

We will review and respond in accordance with applicable regulations.

9. Data Sharing With Service Providers

We may share limited information with:

  • Secure payment processors

  • Event registration platforms

  • Technology service providers

  • Chapter management tools

Each service provider remains independently responsible for compliance with applicable privacy laws.

We do not transfer ownership of personal data.

10. Retention Schedule

Information is retained only as long as necessary to:

  • Provide requested services

  • Maintain nonprofit accounting and donor records

  • Comply with legal, audit, and reporting obligations

  • Protect organizational integrity

When no longer required, information is securely deleted, anonymized, or archived.

11. Automated Decision Making

FIREpwr does not use automated systems to:

  • Approve or deny government benefits

  • Make legal determinations

  • Perform automated profiling with legal or similarly significant effects

Human review governs all meaningful participation decisions.

12. Children & Minor Data

We do not knowingly collect personal data from children under 13 without parental or guardian involvement.

Programs involving minors may require additional consent documentation.

13. Telemarketing & Communication Compliance

FIREpwr communications are:

  • Informational

  • Consent-based

  • Non-commercial in nature

We strive to comply with:

  • TCPA (Telephone Consumer Protection Act)

  • Applicable state telemarketing laws

  • Do-Not-Call standards

  • CTIA messaging principles

  • 10DLC registration requirements

 

14. Accessibility & Equal Access

FIREpwr is committed to:

  • Equal access to programs

  • ADA-aligned digital accessibility

  • Serving diverse communities across urban and rural regions

 

15. California-Specific Enhancements (CPRA)

For California residents:

  • We do not sell or share personal information

  • Sensitive data use is limited

  • We honor access, deletion, and correction rights

  • We do not conduct behavioral advertising

 

16. Virginia, Colorado, Connecticut & Similar State Rights

Residents may request:

  • Access

  • Correction

  • Deletion

  • Data portability

  • Appeal of denied requests

 

17. Utah & Texas Notice

Although nonprofit exemptions may apply in certain jurisdictions, FIREpwr voluntarily provides:

  • Access and deletion request channels

  • Transparency regarding data practices

  • Opt-out options for non-essential communications

 

18. Changes to This Addendum

We may update this Addendum to reflect new laws or regulatory guidance.

Updates will be posted with the revised effective date.
